Role of the Arbitrator
When sufficient disagreement exists regarding contract language, usually prompted by a perceived violation and grievance, arbitrators may be called upon to interpret the contract language and render a decision.
The original intent of the negotiating parties must be the controlling factor when contract language is under review. (Think of it this way: The parties to the agreement determine the value of their exchange. The role of the arbitrator is to interpret the contract language, consistent with the negotiated preferences of both parties.)
When interpreting contract language, arbitrators also consider the negotiation's history, the clarity of the contract language, and evidence of the parties' intentions.
