The Courts
PEF has a Legal Department that provides a variety of legal services to PEF and individual PEF members who are facing disciplinary charges where the proposed penalty is termination. These services include providing representation to the union or individual members in civil suits in state and federal courts, in administrative proceedings before various agencies, and in arbitrations under all of the collective bargaining agreements negotiated by PEF.
It may also be possible to seek court review of a GOER Article 17 Out-of-Title Work Decision when it is believed to be arbitrary or capricious.
However, PEF does not normally utilize the courts to resolve contract issues. Violations of an Article of the contract are appropriately processed through the Contract Grievance procedure. In most cases, binding arbitration replaces court action with respect to contract violations.
